1. Acceptance of Terms

By creating an account or using WhatsBiz, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service. These terms apply to all users of WhatsBiz worldwide.

2. Description of Service

WhatsBiz is operated by Degordons Tech Enterprises. The service enables automated customer conversations, order management, and payment link generation. WhatsBiz operates via the WhatsApp Cloud API provided by Meta Platforms, Inc.

3. Eligibility

You must be at least 18 years old to use WhatsBiz. You must have a valid WhatsApp Business account and comply with Meta's WhatsApp Business Policy. You must provide accurate information when creating your account. You are responsible for maintaining the security of your account credentials.

4. WhatsApp and Meta Compliance

Your use of WhatsBiz must comply with Meta's Terms of Service, WhatsApp Business Policy, and all applicable WhatsApp guidelines. You must not use WhatsBiz to send spam, unsolicited messages or bulk promotional messages outside of WhatsApp approved templates. You are solely responsible for the content of messages sent through your WhatsApp number. WhatsBiz is not responsible for any violations of Meta's policies by users of our platform.

5. Acceptable Use

You agree not to use WhatsBiz for any unlawful purpose. You agree not to use WhatsBiz to deceive, defraud or mislead your customers. You agree not to use WhatsBiz to send messages containing illegal content, hate speech, or content that violates the rights of others. You agree not to attempt to reverse engineer, hack or disrupt the WhatsBiz platform. We reserve the right to suspend or terminate accounts that violate these terms.

6. Free and Paid Plans

WhatsBiz offers a free plan with 500 messages per month and up to 50 products. Paid plans are available with additional features and higher usage limits. We reserve the right to change pricing and plan features with 30 days notice. Continued use of the service after pricing changes constitutes acceptance of the new pricing.

7. Payments

Payment processing is handled by Paystack. WhatsBiz does not store your payment card details. All payments are subject to Paystack's terms and conditions. Refunds are handled on a case by case basis at our discretion.

8. Data and Privacy

Our collection and use of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference. You retain ownership of your business data and customer data. By using WhatsBiz, you grant us a limited licence to process your data solely for the purpose of providing the service.

9. Limitation of Liability

WhatsBiz is provided on an "as is" basis without warranties of any kind. We do not guarantee that the service will be uninterrupted or error-free. We are not liable for any lost profits, lost data, or indirect damages arising from your use of WhatsBiz. Our total liability to you for any claims arising from these terms shall not exceed the amount you paid us in the 3 months preceding the claim.

10. Termination

You may terminate your account at any time from the Settings page. We may suspend or terminate your account if you violate these terms. Upon termination, your data will be deleted within 30 days in accordance with our Privacy Policy.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or in-app notice. Your continued use of WhatsBiz after changes are posted constitutes your acceptance of the updated terms.
